Terms and Conditions Last updated: April 7, 2026 1. Introduction These Terms and Conditions ("Terms") govern the use of the software products offered by Bjoern Olausson ("Provider", "we", "us"), based in Germany. By purchasing, downloading, installing, or using any of our products, you ("Customer", "you") agree to be bound by these Terms. If you do not agree, do not use our products. 2. Products We currently offer the following software products: (a) Android Sync for Proton – A native Android application that enables two-way synchronization of contacts and calendars with Proton Mail accounts. The app uses end-to-end encryption for all synced data. (b) Mail Checker for Proton Mail – A Firefox browser extension that provides inbox monitoring, email reading, composing, and notification features for Proton Mail accounts. These products are independent projects and are not affiliated with, endorsed by, or officially connected to Proton AG. 4. License Upon valid purchase or subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to use the purchased product for personal or business purposes in accordance with these Terms. You may not sublicense, sell, resell, distribute, copy, modify, reverse-engineer, or create derivative works of our products, except as permitted by applicable law (including Sections 69d and 69e of the German Copyright Act, UrhG). 5. Purchases and Payments All purchases are processed through Paddle.com Market Limited ("Paddle"), which acts as our Merchant of Record. Paddle handles payment processing, invoicing, sales tax, and VAT compliance. When you make a purchase, your contractual relationship for payment is with Paddle. Paddle's terms apply to the payment transaction: https://www.paddle.com/legal/terms Prices are displayed inclusive of applicable taxes where required by law. We reserve the right to change prices at any time. Price changes do not affect existing active subscriptions until the next renewal period. 6. Subscriptions If you purchase a subscription: (a) Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. (b) You may cancel your subscription at any time through your Paddle customer portal. Cancellation takes effect at the end of the current billing period. (c) Upon cancellation, you retain access to the product until the end of the already-paid billing period. (d) We may modify subscription terms or pricing with at least 30 days advance notice. If you do not agree to the changes, you may cancel before they take effect. 7. One-Time Purchases For products purchased as a one-time payment: (a) You receive a perpetual license to use the version of the product available at the time of purchase. (b) Updates and new features may or may not be included, depending on the specific product offering described at the time of purchase. 8. System Requirements and Compatibility Our products require compatible devices and third-party services (such as a Proton Mail account) to function. We do not guarantee compatibility with all device configurations, operating system versions, or third-party services. It is your responsibility to ensure your device meets the stated requirements before purchase. 9. Availability and Updates We strive to keep our products functional and up to date but do not guarantee uninterrupted availability or ongoing development. We may release updates, modify features, or discontinue a product at our discretion. For subscriptions, discontinuation entitles you to a pro-rata refund for any remaining prepaid period. 10. Third-Party Services Our products interact with services provided by Proton AG and may rely on their APIs and infrastructure. We are not responsible for changes, outages, or discontinuation of third-party services that may affect the functionality of our products. If a third-party change renders a product permanently non-functional, we will notify affected customers and, for active subscriptions, provide appropriate refunds. 11. Intellectual Property All intellectual property rights in our products, including source code, design, trademarks, and documentation, remain with the Provider. Your license to use the product does not transfer any ownership rights. 12. Limitation of Liability To the extent permitted by German law: (a) We are liable without limitation for damages caused by intent or gross negligence, for damages arising from injury to life, body, or health, and for liability under the German Product Liability Act (Produkthaftungsgesetz). (b) For slight negligence, we are only liable in the event of a breach of a material contractual obligation (Kardinalpflicht), and liability is limited to the foreseeable, typically occurring damage. Material contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose compliance you may regularly rely. (c) We are not liable for data loss to the extent you have failed to take reasonable data backup measures. (d) The above limitations also apply to our vicarious agents (Erfuellungsgehilfen). 13. Warranty The statutory warranty rights under German law (Sections 327 et seq. BGB for digital products) apply. If a product has a defect, you are entitled to the remedies provided by law, including supplementary performance (update or new delivery), reduction of the price, or termination of the contract. The limitation period for warranty claims is two years from delivery of the product or, for subscriptions, from delivery of each update. 14. Data Protection We process personal data in accordance with our Privacy Policy, available at https://olausson.de/privacy-policy.txt, and in compliance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). 15. Right of Withdrawal (Widerrufsrecht) If you are a consumer within the European Union, you have the right to withdraw from the contract within 14 days of purchase without giving any reason. To exercise this right, contact us at mail+legal@olausson.de with a clear statement of your decision. If you have expressly consented to the digital content being provided before the withdrawal period has expired and acknowledged that you thereby lose your right of withdrawal, the right of withdrawal may be excluded in accordance with Section 356(5) BGB. Governing Law and Jurisdiction These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in the EU, you also retain the protection of mandatory provisions of the law of your country of residence. The place of jurisdiction for all disputes is the competent court at the Provider's place of residence in Halle (Saale), unless mandatory statutory provisions designate a different jurisdiction. 17. Online Dispute Resolution The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless required by law. 18. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the original. 19. Changes to These Terms We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email or through the product interface at least 30 days before they take effect. Your continued use of the product after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may terminate your subscription or stop using the product. 20.
